Cathedral City to Pass Collective Ban

CATHEDRAL CITY TO PASS COLLECTIVE BAN

In what has to be one of the most rapid responses ever, the Cathedral City staff has put together an ordinance to ban collectives. Like all the ordinances that have been passed, it is way off base and violates state law. However, because there has been no appellate court decision, there is no case law. There is a case from Anaheim that is being appealed by ASA that is challenging these bans as unconstitutional. The argument goes that the ban is in conflict with California state law, and, as a result of that conflict, local bans are preempted because the state has clearly expressed an intent that dispensaries be considered legal entities.

In any case, Cathedral City is going ahead with the ban so please drop by the Cathedral City Council meeting this Wednesday at 6:30 p.m. and let them know that what they are doing is ethically and legally wrong. They need to hear that what they are doing is wrong. If they don't hear it from you, they are not going to hear it.
